Terms and Conditions: "Better Together" Ambassador Challenge

Promoter: ‘everyday better+’, everyday better Pty Ltd (The Club)

These terms and conditions govern the operation of the "Better Together" Ambassador Challenge ("the Challenge"). Participation in the Challenge is deemed acceptance of these terms.

1. Competition Period

1.1 Start and End Date: The Challenge commences on 09/10/25 and concludes on the 10/11/25 or precisely when the Club’s management determines that the remaining Founding Membership allocation has been filled and closed (the "Closing Date").

1.2 Club Discretion: The Club reserves the right to determine the Closing Date at its sole discretion, without prior notice. All referrals must be completed and processed by the Closing Date to be eligible

2. Eligibility, Conditions, and Forfeiture

2.1 Eligible Referrer: Entry is open only to existing, current, and financial everyday better+ Club Members (the "Referrer") as of the commencement date of the Challenge. Employees of everyday better+ are excluded from winning the prize.

2.2 Eligible Referral (Successful New Club Member): A "Successful New Club Member" is defined as a prospective client who:

a) Is a new client who has not previously held a membership or completed a paid trial/commitment at the Club.
b) Agrees to a Club Membership agreement with everyday better+ during the Competition Period.
c) Has made all initial payments (including joining fees and initial membership dues) as per their agreement, and whose membership is deemed "successfully activated" upon:

i. Completion of the online application and purchase of a Club Membership;
ii. Formal acceptance of the membership agreement terms; and
iii. Clearance of the first scheduled payment or direct debit.

2.3 Clawback Condition (Forfeiture of Prize): Should the Successful New Club Member credited to the Referrer cancel their Club Membership, default on their payment obligations, or otherwise terminate their membership agreement within ninety (90) days of their membership commencement date, the Club reserves the absolute right to withdraw the Prize from the Referrer. If the Prize has already been awarded, the Club may revoke the remaining balance of the Prize term.

3. Entry and Referral Process

3.1 Method of Entry: Entry is automatic upon a Referrer making a Successful New Club Member referral, provided the Successful New Club Member meets all membership requirements, adheres to the terms of their agreement, and the conditions set out in Section 2 are met.

3.2 Mandatory Naming: For a referral to be valid and counted toward the Challenge tally, the Successful New Club Member must clearly communicate the Referrer's full name to the Club at the time of their membership signing. Referrals cannot be claimed or attributed retroactively.

3.3 One Referrer per Referral: Each Successful New Club Member can only be referred by and credited to one Referrer. In the event of any dispute over the referring party or the final count, the Club's decision will be considered final and binding.

4. Judging and Winner Selection

4.1 Basis of Win: The winner will be the eligible Referrer who has accrued the highest number of Successful New Club Members between the Challenge start date and the Closing Date. 

4.2 Tie-breaker: In the event of a tie for the highest number of Successful New Club Members, the winner will be the Referrer whose last credited referral was processed and signed earliest in the Competition Period.

4.3 Notification: The winner will be notified via email and/or phone within five (5) business days of the Closing Date. The winner's first name may be announced within the Club premises or official member communications.

5. Prize

5.1 Prize Details: The prize is a complimentary One (1) Year everyday better+ Club Membership (the "Prize"), consisting of fifty-two (52) consecutive weeks of membership. The Prize will commence immediately following the expiration of the winner’s current paid membership term. The exact commencement and cessation dates will be formally notified to the winning member. The Prize term runs continuously and will not be extended due to any period of membership suspension, hold, or pause initiated by the winning member.

5.2 Prize Conditions: The Prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or other goods or services. The Club is not responsible for any tax implications arising from the Prize.

6. General Conditions

6.1 Liability: The Club is not responsible for any lost, late, or misdirected referrals, or for any inability of a Referrer to secure a referral before the Closing Date.

6.2 Disputes: In the event of any dispute regarding these terms or the outcome of the Challenge, the decision of everyday better+ Club Management is final, and no correspondence will be entered into.

6.3 Privacy: Personal information collected for this Challenge will be handled in accordance with the Club’s Privacy Policy.
