Terms & Conditions: 50% Off First Week Introductory Offer

1. The Offer These Terms and Conditions govern the "50% Off First Week" introductory offer (the Offer) provided by everyday better Pty Ltd. By submitting the registration form, you agree to these terms.

2. Eligibility

  • New Members Only: This Offer is strictly available to individuals who have not previously held a membership or completed a trial with everyday better Pty Ltd.

  • Age Requirements: You must be 18 years of age or older. If you are aged 16 or 17, you may only redeem this Offer if a parent or legal guardian co-signs your membership agreement and assumes financial and legal responsibility.

  • Redemption: To claim the Offer, you must register your details via our official online form. Scanning our promotional QR code will direct you to the form, but scanning the code is not a mandatory requirement for eligibility.

3. How It Works

  • The Discount: The Offer entitles you to a 50% discount on the standard weekly rate for your first week of an everyday better Club Membership.

  • Activation: The discounted week commences on the day of your first scheduled visit and induction at the club.

  • Ongoing Membership: At the conclusion of your first week, your membership will automatically roll over into a standard weekly everyday better Club Membership at the full ongoing rate, subject to our standard Membership Terms and Conditions.

  • Cooling-Off Period: In accordance with NSW Fair Trading guidelines for fitness agreements, you are entitled to a 7-day cooling-off period from the date you sign the full membership agreement.

4. Health, Safety & Risk Warning

  • Pre-Exercise Screening: Proactive health is our priority. Before commencing any training or using our recovery facilities, you must complete a standard Pre-Exercise Questionnaire. We reserve the right to refuse access or require a medical clearance certificate if we have reasonable concerns about your fitness to participate.

  • Risk Warning (Civil Liability Act 2002 - NSW): Participation in fitness, training, and recovery activities (including but not limited to weight lifting, sauna, and cold plunge use) involves inherent risks, including the risk of personal injury. By participating, you acknowledge and assume these risks.

5. Liability & Australian Consumer Law

  • Consumer Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to services rendered with due care and skill, and that are fit for purpose.

  • Limitation of Liability: To the maximum extent permitted by the ACL and the Civil Liability Act 2002 (NSW), everyday better Pty Ltd excludes liability for any personal injury, loss, or damage to personal property arising out of your participation in club activities or use of the facilities, except where such injury or loss is directly caused by our gross negligence.

6. Privacy We respect your privacy. All personal information collected during registration and your use of the club is managed in strict accordance with the Privacy Act 1988 (Cth). We will use your information to facilitate your membership, communicate with you about your account, and provide our services. You can request access to your data or ask us to update it at any time.

7. General

  • This Offer cannot be used in conjunction with any other promotion, discount, or offer.

  • The Offer is not redeemable for cash and is strictly non-transferable.

  • everyday better Pty Ltd reserves the right to amend, withdraw, or extend this Offer at our discretion, though we will always honour valid registrations made prior to any changes.

  • These Terms and Conditions are governed by the laws of New South Wales, Australia.
