Referral Challenge (November 2026) — Terms and Conditions

1. Promoter

1.1. The promoter is Everyday Better Pty Ltd (ABN 57 676 365 450) of 441 Argyle Street, Moss Vale NSW 2577 (the Promoter). Questions: hello@everydaybetter.com.au.

2. Definitions

2.1. Member means a person holding a paid Everyday Better club membership that is not suspended, paused or in arrears.

2.2. New Member means a person who has not held an Everyday Better membership at any time in the 12 months before their sign-up.

2.3. Referrer means a Member who refers a New Member in accordance with clause 4.

2.4. Referred Member means a New Member who names a Referrer at sign-up in accordance with clause 4.

2.5. Valid Referral means a referral that satisfies clause 4 and is not excluded under clause 5.

2.6. Promotional Period means 12:00 am on 1 November 2026 to 11:59 pm on 30 November 2026, Sydney time (AEDT).

3. Eligibility

3.1. Entry is open to Members aged 18 years or over who are resident in Australia.

3.2. Employees and contractors of the Promoter, and their immediate families, are not eligible to enter.

4. How to enter

4.1. To enter, a Referrer must refer a New Member who signs up for a paid Everyday Better membership during the Promotional Period.

4.2. The Referred Member must tell the Promoter the Referrer's name at the time of sign-up, and the Promoter will record it on the Referred Member's account. Referrals cannot be added or changed after sign-up.

4.3. There is no limit on the number of referrals a Referrer may make. No purchase beyond the Referred Member's ordinary membership fee is required.

5. Invalid referrals

5.1. A referral is not a Valid Referral if:

(a) the Referred Member is not a New Member;

(b) the Referred Member's first membership payment is not received, or is later refunded, reversed or charged back;

(c) the Referred Member's membership is cancelled, suspended or in arrears at the close of the Promotional Period;

(d) the Referrer and the Referred Member are the same person, or the referral involves duplicate or fictitious accounts;

(e) the Referrer offered the Referred Member cash or other inducements not provided by the Promoter; or

(f) the referral was obtained by fraudulent, misleading or unfair conduct, or by any breach of these Terms.

6. Prizes

6.1. First prize: twelve (12) months of complimentary Everyday Better club membership (52 weeks at $102 per week), valued at $5,304.

6.2. Second prize: six (6) months of complimentary Everyday Better club membership (26 weeks at $102 per week), valued at $2,652.

6.3. Total prize value: $7,956.

6.4. Each prize is applied to the membership rate the winner is paying at the close of the Promotional Period (founder rate of $99 per week or club rate of $102 per week) and begins at the winner's next billing date after they accept the prize. If the winner's membership ends before the prize period ends, the unused portion lapses.

6.5. Prizes are not transferable, exchangeable or redeemable for cash.

6.6. 90 day retention condition. If, within ninety (90) days of a Referred Member's sign-up, that Referred Member cancels or stops paying for their membership, the referral ceases to be a Valid Referral. If, as a result, a winner would no longer have won the prize awarded to them, the Promoter may end the complimentary period from the winner's next billing date and award the remainder of the prize to the Referrer who would then have won. The Promoter will not charge a winner for complimentary weeks already received.

7. Determination of winners

7.1. The first prize is awarded to the Referrer with the highest number of Valid Referrals; the second prize to the Referrer with the second-highest number. A Referrer must have at least one Valid Referral to win.

7.2. Counts are based on the Promoter's records, which are final except in the case of manifest error.

7.3. Tie-breaker. If two or more Referrers are tied, the prize goes to the Referrer who first reached the tied number of Valid Referrals, by date and time of the Referred Member's sign-up.

7.4. If no Referrer has a Valid Referral, no prize is awarded. If only one does, only the first prize is awarded.

8. Notification and claiming

8.1. Winners will be notified by email and/or phone within five (5) business days after the close of the Promotional Period, and their first names and suburb may be published on the Promoter's website or social channels.

8.2. A winner must accept the prize within fourteen (14) days of notification. If a winner cannot be contacted or does not accept within that time, the prize is forfeited and the Promoter may award it to the next-ranked eligible Referrer.

9. General

9.1. The Promoter may verify any entry and may disqualify an entrant who breaches these Terms or engages in fraudulent, misleading or unfair conduct.

9.2. If the promotion cannot run as planned for reasons beyond the Promoter's reasonable control (including technical failure, fraud or a direction of a regulator or court), the Promoter may, subject to any applicable law, suspend, modify or cancel the promotion and will notify Members by email.

9.3. The Promoter's decision on any matter relating to the promotion is final, and no correspondence will be entered into, except as required by law.

9.4. Nothing in these Terms excludes, restricts or modifies any consumer guarantee or other right under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, the Promoter is not liable for any loss arising from participation in the promotion or use of a prize, except where caused by the Promoter's negligence or breach of these Terms.

9.5. Privacy. The Promoter collects the names of Referrers and Referred Members to administer the promotion and will handle personal information in accordance with the Privacy Policy published on its website. A Referrer should only refer people who have agreed to be named.

9.6. This promotion is not sponsored, endorsed or administered by, or associated with, any social media platform on which it is advertised.

9.7. By participating, entrants agree to be bound by these Terms. These Terms are governed by the laws of New South Wales.
